Is there any legality to a city forced expropriation for the benefit of a private project? Quebec has a law called PPU heres the website but its in french http://www.mamrot.gouv.qc.ca/amenagement/outils/amen_outi_plan_prog.asp It essentially allows the city to expropriate and sell the property to a private entity with NO PUBLIC benefit. Does this go againsta any Federal legislation? isnt this unconstitutional??
The Canadian constitution does not provide any protection from expropriation. However, when a power to expropriate is exercised the expropriating authority must comply with the requirements of the applicable statute.
