road expropriation

Land was taken by the municipality for a road through my father-in-laws property many years ago-1950's, dividing the land with a gravel roadway. He was never notified or compensated although apparently there was a notice in the local newspaper. The road was pushed through by soldiers at the local base and as he served in WW2, and there was really no traffic, he never said anything. Years later he went to city hall to find out about compensation but was shifted from one department to another and never got anywhere. He asked his son to look into it but he never got anywhere. Now he has passed away but my mother in law is now asking if there is not a duty to compensate for land taken. Is there a time limit for compensation, does a municipality have a duty to compensate for land taken and where does one begin?

The answer to your question depends upon which expropriation statute applies. What municipality is it? Which province?
