Hi! My name is Eva Prados from Puerto Rico. I'm a law student doing a research about the expropriation process of differents states. My research is focus on "public purpose" definitions as was the issue in the US - Kelo v. City of New London- and the "hearing" opportunities for the people to be expropiate.
My question is if in Canada Expropriation Law could the state to expropriate a private property for economic development as was the holding in the US Supreme Court desition at Kelo v. City of New London??
The law varies from province to province in Canada. In Manitoba, the Court of Appeal is presently considering whether municipalities can expropriate for economic development. A decision is expected in the next month.
